OVERVIEW

Welcome to DAR Studio Arts (“DAR Studio Arts,” “we,” “us,” “our”). We operate this website and store, and provide related information, content, features, tools, and services (the “Services”). Our store is powered by Shopify.
By visiting or purchasing from our store, you agree to these Terms of Service (“Terms”) and our Privacy Policy ([link to your Privacy Policy]) and Refund/Returns Policy ([link]). If you do not agree, please do not use the Services.

1. ACCESS & ACCOUNT

You confirm you are of the age of majority in your place of residence (or you have parental consent for minors using your devices). You agree to provide accurate, current, and complete information and to keep your account credentials secure. You are responsible for all activity on your account.

2. OUR PRODUCTS & CONTENT

We work hard to display colors and details accurately, but screens can vary. Product descriptions, pricing, and availability may change at any time. We may limit sales by person, household, region, or jurisdiction and may discontinue products at any time.

3. ORDERS

Your order is an offer to buy; we may accept or reject any order. We must receive and process your payment before acceptance. If we cancel or change an order, we will attempt to notify you using the contact details you provided.
All purchases are subject to our Refund/Returns Policy ([link]). You confirm purchases are for personal/household use and not for commercial resale.

4. PRICES & BILLING

Prices may change without notice. Unless stated otherwise, prices exclude taxes, shipping, handling, and import duties. You agree to provide valid payment details and authorize us (and our payment processors) to charge your payment method for all amounts due, including applicable taxes and shipping.

5. SHIPPING, DELIVERY & CUSTOMS

We ship from France, Switzerland, and the United Kingdom (depending on stock and destination). Delivery times are estimates and are not guaranteed.

  • Risk of loss: For customers in the EU/UK, risk passes when the goods are delivered to you (or your designated recipient). For customers elsewhere, risk may pass when we hand items to the carrier, as allowed by local law.

  • Duties & taxes: International orders outside your local origin may be subject to import duties, taxes, and fees. These are your responsibility.

6. DIGITAL PRODUCTS – LICENSE & WITHDRAWAL

When you buy a digital file, we grant you a non-exclusive, non-transferable license for personal, non-commercial use only (e.g., print for your home). You may not resell, redistribute, make derivatives for sale, use for merchandise, NFTs, training AI models, or any commercial purpose without our written permission.
EU/UK: By choosing “Download now” or accessing the download link, you expressly consent to immediate delivery of digital content and acknowledge that your right of withdrawal ends once the download starts (Consumer Rights rules).

7. INTELLECTUAL PROPERTY

All artworks, images, designs, text, and other content in the Services are owned by Douaa Arkoub / DAR Studio Arts or our licensors and are protected by copyright and other laws. Except for the limited license in Section 6, no rights are granted to you. You may not copy, reproduce, distribute, publicly display, modify, or make derivative works without prior written consent.

8. OPTIONAL TOOLS & THIRD-PARTY LINKS

We may provide access to third-party tools or links “as is” and “as available,” without warranties. Your use of third-party services is at your own risk and governed by their terms and policies.

9. RELATIONSHIP WITH SHOPIFY

DAR Studio Arts is powered by Shopify, but your purchase is with DAR Studio Arts. Shopify is not a party to your transaction and is not responsible for our products, services, or any related claims.

10. PRIVACY

Personal data is handled per our Privacy Policy ([link]) and may also be processed by Shopify per Shopify’s Privacy Policy (available on shopify.com). By using the Services, you consent to these practices, including transfers to other countries where our providers operate.

11. FEEDBACK & REVIEWS

If you submit reviews, suggestions, or other content (“Feedback”), you grant us a worldwide, perpetual, royalty-free license to use and display that Feedback in any media. You represent you own the Feedback and that it does not violate rights of others. We may remove Feedback that violates these Terms.

12. ERRORS & CHANGES

We may correct errors or update information (including pricing and availability) and cancel orders due to inaccuracies at any time, including after you submit an order.

13. PROHIBITED USES

You agree not to misuse the Services (e.g., illegal acts, IP infringement, harassment, spamming, introducing malware, scraping, or attempting to bypass security). We may suspend or terminate access for violations.

14. TERMINATION

We may suspend or terminate access at any time. Sections intended to survive termination (including IP, license, disclaimers, limitations, indemnity, and governing law) will continue.

15. DISCLAIMER OF WARRANTIES

Except as expressly stated by us, the Services and all products are provided “as is” and “as available.” We disclaim implied warranties to the maximum extent permitted by law. Some jurisdictions do not allow disclaimers; your rights may vary.

16. LIMITATION OF LIABILITY

To the fullest extent permitted by law, DAR Studio Arts and our affiliates, officers, employees, agents, suppliers, and licensors will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits/revenue/data, arising from your use of the Services or products.

17. INDEMNIFICATION

You agree to indemnify and hold harmless DAR Studio Arts (and our affiliates and partners) from claims, damages, and expenses arising from your breach of these Terms or misuse of the Services.

18. SEVERABILITY

If any provision is unlawful or unenforceable, it will be limited or eliminated to the minimum extent, and the remaining provisions will remain in effect.

19. WAIVER & ENTIRE AGREEMENT

Failure to enforce a provision is not a waiver. These Terms, together with the policies referenced here, are the entire agreement between you and us concerning the Services.

20. ASSIGNMENT

You may not assign these Terms without our prior written consent. We may assign or transfer our rights and obligations without notice.

21. GOVERNING LAW & DISPUTES

These Terms are governed by the laws of Austria, without regard to conflict-of-law rules, and the courts of Vienna, Austria will have exclusive jurisdiction. EU consumers may also bring claims in the country where they live.

23. CHANGES TO THESE TERMS

We may update these Terms by posting a new version here. Material changes will be notified in line with applicable law. Continued use of the Services after changes means you accept the revised Terms.
